1. Acceptance of these terms
These terms apply to the FlyGD Wingman desktop application (“Wingman”, “the software”) and to this website at wingman.zoolanders.vip. By downloading, installing or using the software, or by using this site, you agree to them. If you do not agree, do not install or use the software.
“We”, “us” and “the maintainers” mean the volunteer contributors who develop and publish the project. There is no company, no incorporated entity and no commercial service behind it.
2. What the software is
Wingman is a free companion application for OBS Studio that runs on your own Windows PC. It watches your OBS recording folder, lists finished recordings, can combine selected recordings into a single video, and can upload recordings you select to your own YouTube channel. It can also collect EVE Online combat logs covering a selected recording and post them to a Discord webhook you configure.
It is a local tool. There is no hosted service, no user account, no server-side processing and no subscription. Nothing in these terms should be read as a promise of a service, because there is no service to provide — only software you run yourself.
The software is provided free of charge. We do not charge for it, and we do not accept payment for it.
3. Open-source licence
FlyGD Wingman is open-source software released under the MIT Licence. The full licence text accompanies the source code in the project repository, and that licence governs your rights to use, copy, modify and redistribute the software.
Where the MIT Licence and these terms differ on your rights in the software itself, the MIT Licence prevails. These terms cover the conditions of use of the published application and this website; they do not narrow the rights the licence grants you.
The software bundles third-party components, including a build of FFmpeg and Python libraries, each under its own licence. Those licences continue to apply to those components.
4. Your responsibilities
You are responsible for how you use the software. In particular:
- Your content. You are responsible for the recordings you upload and for having the rights to publish them — including any game footage, music, voice chat or other people's likenesses they contain. Uploads must comply with YouTube's Terms of Service and Community Guidelines and with applicable law.
- Your account. You are responsible for the Google Account you connect and for the videos that appear on your channel as a result of using the software.
- Deletion is permanent. The software includes a function that permanently deletes selected recordings from your disk after a confirmation prompt. It does not use the Recycle Bin and cannot be undone. Keep your own backups of anything you care about.
- Your credentials. Google OAuth tokens and any Discord webhook URL you configure are stored unencrypted on your PC. Keeping your computer and your user account secure is your responsibility. See the Privacy Policy for details.
- Your Discord webhook. If you use the combat-log feature, you are responsible for the Discord server and channel you post to and for the log contents you send there.
- No automated uploading. Wingman is designed so that every upload is one you selected and started. You must not script, automate or otherwise trigger uploads without a person choosing them, and you must not modify or drive the application to do so.
- Shared quota. The application's uploads draw on a single YouTube API quota shared by everyone using it. Please do not deliberately exhaust it, and be aware that an upload can fail because other users have consumed the day's quota rather than because of anything you did.
- Lawful use. Do not use the software to upload unlawful material, to infringe copyright, to harass anyone, or to circumvent the terms or technical limits of any third-party service.
5. Third-party services
Wingman works alongside services and software operated by other people. Your use of each is governed by that provider's own terms, and we have no control over them.
YouTube and Google
Uploading uses YouTube API Services through your own Google Account, and by using that feature you agree to be bound by the YouTube Terms of Service. Your use of it is subject to the YouTube Terms of Service, the Google Terms of Service and the Google Privacy Policy. Google may change, restrict or withdraw API access at any time, which could stop the upload feature working. Google may also enforce quotas that limit how much you can upload. We cannot restore access that Google has restricted, and we are not responsible for actions Google or YouTube take in respect of your account or your videos.
OBS Studio
Wingman reads OBS Studio's configuration to find your recording folder and watches the files OBS produces. It is not a plugin, does not modify OBS, and is not part of the OBS project. OBS Studio is separate software with its own licence and terms, and you must obtain and use it accordingly.
Discord
The combat-log feature posts to a Discord webhook that you create and configure. Your use of Discord is subject to the Discord Terms of Service and Discord Privacy Policy. If you do not configure a webhook, the software never contacts Discord.
EVE Online and CCP Games
The combat-log feature reads log files that EVE Online writes on your own computer. EVE Online is a product of CCP hf. and its use is governed by CCP's own agreements. This project uses no EVE Online artwork, assets or intellectual property, and it does not interact with the game client or the game's servers in any way — it only reads text files already saved on your disk.
6. No affiliation
FlyGD Wingman is an independent, community-built project. It is not affiliated with, endorsed by, sponsored by, or approved by Google LLC, YouTube, the OBS Project or OBS Studio's developers, Discord Inc., or CCP hf. and EVE Online.
All product names, logos, trademarks and registered trademarks mentioned on this site or in the application are the property of their respective owners, and are used only to describe what the software is compatible with. Their use does not imply any endorsement or relationship.
7. Availability
The software is offered as-is, when it is offered at all. We do not guarantee that the application, this website, the download links, or any feature within them will remain available, or that development will continue.
Specifically, and without any obligation to give notice, we may: stop developing or publishing the project; remove or replace releases; change or remove features; or discontinue the site. Features that depend on third-party services — YouTube uploading above all — may stop working for reasons outside our control, including changes to Google's APIs, policies or quotas, or the withdrawal of the project's API access.
Because the project is open source, you always retain the option to keep using a copy you already have, or to fork and maintain the source yourself under the MIT Licence.
There is no service-level commitment, no uptime guarantee, and no obligation to provide support, bug fixes or updates.
8. Disclaimer of warranties
The software and this website are provided “as is” and “as available”, without warranty of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
We do not warrant that the software will be uninterrupted, error-free or secure; that it will work with any particular version of Windows, OBS Studio or EVE Online; that uploads will succeed or complete; that stitched or uploaded video will be free of defects; or that it will not, through fault or misuse, result in the loss of files. You use it at your own risk, and you should keep backups of recordings that matter to you.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you; nothing here is intended to exclude rights that cannot lawfully be excluded, including any statutory consumer rights you may have.
9. Limitation of liability
To the maximum extent permitted by law, the maintainers and contributors shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, recordings, profits, revenue, goodwill, or the suspension, restriction or termination of any third-party account, arising out of or in connection with the software or this website — whether in contract, tort (including negligence) or otherwise, and even if advised of the possibility of such damage.
This is free software given away at no charge. To the extent any liability cannot be excluded, our total aggregate liability to you is limited to the greater of the amount you paid for the software — which is nothing — or the minimum amount permitted by applicable law.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
10. Changes to these terms
These terms may be updated from time to time — for example when the software gains a feature that needs covering. The current version is always published here at wingman.zoolanders.vip/terms, with the “last updated” date at the top of the page reflecting the most recent revision.
Continuing to use the software or this site after an update means you accept the revised terms. If you do not accept them, stop using the software. Because this site is developed in the open, the complete revision history of this document is public in the project repository.
